If someone has DeCSS on their site( in England & Wales), that is fine, if someone downloads it it is fine. If they use it to decrypt that is fine. What is not OK is then copying the decrypted material.
Do you mean copying and distributing further, or just copying (ie for personal use, or backup purposes)? I've never been clear if UK laws allow personal use copies without violating copyright law, or whether it's one of these "yes, it's technically illegal, but we'll never prosecute" affairs.
If copying itself was a violation, then a (software, or streaming) DVD player itself which temporarily cached decrypted data onto its hard disk would be in breach of copyright - which seems preposterous.
(Wasn't there some UK case which established that videotaping TV programmes for later viewing was legit? The 2600 case referred to this as "time-shifted" copying)
