I should have made clear that the lack of evidence of copying was in the MPAA v 2600 case, sorry.

Trying to claim that DeCSS isn't used for copying at all (especially given the new rush of mpeg4/divx conversion tools that have mysteriously started doing the rounds, just at the right time to be used as an example) is not a good idea - all your opponent has to do in court is *themselves* make an illegal copy via DeCSS; showing a DVD movie in court, then removing the DVD drive entirely and showing an MPEG4 version claimed to be converted *using DeCSS* would blow that out of the water in pretty short order.

Funnily enough, the entire resources of the MPAA, its experts, its very expensive lawyers and all the associates were not able to give a single instance of where DeCSS has been used to copy a single DVD anywhere in the world. They all said it could be done, but they had not one shred of evidence it had actually taken place, which for an organisation with the financial clout of the MPAA, is a pretty remarkable omission. The depositions in this regard are an amusing read.

Thus the MPAA has resorted to plausible sounding legal threats, which may have some weight in the US, but there is another world to which they simply do not apply.
