X-Spam-Status: No, score=0.0 required=5.0 tests=none autolearn=failed version=3.0.4

and it always takes the first (.Spam/new) path regardless of the test...

Hmm. How about:

if ( /^X-Spam-Status:[:space:]+Yes/ )

Do you have any other filtering rules in your maildroprc? A .mailfilter?
