Thus far the code hasn't been released, but I assume you read the OHA page about it and the website of androïd where it's written that the code will be released. So they are trying to promote the involving of a developpers community into their product through this.

I think that the relationship between Google and developpers, the open- source willing of the Androïd project and the NDA SDK belong to the same topic.

Again, the fact is ignored that it hasn't been released yet. Even before this
new NDA SDK was released the source code still wasn't available! Instead of
crying foul about the decisions thus far, why not research and work on lots of
different areas of Android; take the time to learn something you might not have
used so far.

I think that Google has a bad communication strategy with Androïd. You can't brand your product as open-source and while this image is driving people into the project over the world, you cheat everyone by only providing releases to few choosen developpers.
