Agreed. But sometimes their 'spirit' is not all that. For returning tabular data (think Excel), business objects can be restrictive. I don't know what he's doing though but I'm assuming it's something along those lines.

Yes, Marco could use something like Sun's cached rowset. On the other hand, if one is going to the trouble of using EJBs, then the practice that is prescribed by Sun is that business logic 'lives' in the EJBs.
I'm only assuming that by passing back a result-set type instance from Session beans, Marco's architecture is not totally following the 'spirit' of EJBs, because there will be some business logic in the code that receives the ResultSet (but I don't really have enough information to back that up yet)...
