can someone tell me (and forgive my ignorance) how to make other processors accept stylesheets using xsl:document (assuming that they dont reach the code, as its in an xsl:choose case)?

It should be acceptable to any conformant XSLT 1.0 processor if you write

<xsl:stylesheet ... version="1.1">

...

<xsl:document> ... <xsl:fallback> ... </xsl:fallback> </xsl:document>
