It's not a question of "illegal", Aaron. Google is the copyright holder, and you have no _right_ to the SDK. They can withdraw your license, at which point your continued use of the SDK would become a matter of copyright infringement, a civil matter for which Google could (potentially) sue you personally.

Not illegal, infringing. As I said, there's a difference.
i am more interested in the underlying "open source" components and writing native code for the platform. they don't own the copyright to the kernel, or its libraries which are open source. we can do whatever we want with these.
Sure, that's safe. It's some of the other efforts that are going on that would seem to be at odds with Google's desires here.
this platform is still vapourware until we actually see some hardware available to general developers and users.
Agreed. Sounds like (late) next year. If they stay on schedule (as we know, all complex hardware/software projects with multiple participants manage to do this as a matter of course... =D )
if you have issues with the legality of the mailing list, take it up with google directly, i dont think many of us here are concerned about it. its an open discussion forum, this isnt china or russia - we are entitled to discuss, and post our thoughts and experiences.
Not me. Don't get me wrong, Aaron: I'm just attempting to distinguish between the PR hype around Android (e.g. "open source", "free", "reduces fragmentation", "gets the crabgrass out of your lawn", "leads to enlightenment", etc.) and the actual facts. I don't expect that Google will actually shut this group down or sue anyone; I'm just intrigued by the notion that they certainly could if they decided to...
no-one signed an NDA for the SDK.
Anyone who downloaded it agreed to its Terms and Conditions (with Google, not with the "Open Handset Alliance")...
what google should do soon is open everything up; or, they may find themselves on the end of a GPL volation somewhere for whatever reason someone who does enough reverse engineering can find out.
They've stated that they're not planning on opening anything up before "late 2008" or when devices actually ship, whichever comes last...
