I think there's a strong argument for that, so it still looks like a Mandrake bug. :-)

Okay, maybe it's a bug in the SPEC of the Mandrake apache RPM. However, we're not going to be able to change that. It might be possible to get Mandrake to make upcoming apache RPMs provide that directory. But there'll still be a large number of users using Mandrake <=8.2 who don't have a apache RPM that provides this.

So the easiest fix is to drop the Requires: from courier.
