1/ No idea on patents pending - I don't know of us having a position on that or not. Also no idea on whether 'use' is needed for us wrt patents.

2/ Afaik - people don't have to say 'use'. It's not one of the copyright pillars (again... afaik...). From our own license:

reproduce, prepare Derivative Works of, publicly display, publicly perform, sublicense, and distribute

So we have:

distribute: Yes prepare Deriv: No

and nothing stated for the others. So that's a question - do we require the others be Yes to distribute or are they just considered niceties. My Cat B suggestion is saying that all we need to distribute something is permission to distribute.

While it's not very open source, it does perfectly fit our category B definition of "attribution + no modification".
